Overview
There is no substitute for experience when it comes to helping companies in financial distress. At Fredrikson & Byron, our Bankruptcy, Restructuring & Workouts Group has successfully handled over 150 corporate reorganizations – in Minnesota and across the country – and the two senior members of our team have a combined total of more than 70 years of business bankruptcy experience. Behind those reorganizations are many more out-of-court workouts and confidential advice and planning engagements. These representations include services for debtors, creditors, buyers and sellers of distressed assets, receivers and other parties that may be affected by the financial distress of a business.

Achieving our client’s goals is about more than legal expertise. It’s about taking time to understand a client’s specific financial and operating concerns, and providing real and practical business solutions and respectful – yet honest – counsel on how to address critical issues. It’s about effective negotiation and advocacy with multiple parties such as lenders and unsecured creditors, and the ability to act quickly and efficiently under challenging circumstances. Finally, it’s about having the skills to generate both primary and alternative options that can help the clients meet their objectives. At Fredrikson & Byron, these are the attributes that set us apart.

Professional Leadership
One of our members was Chair and two others were members of the committee that drafted the new and recently enacted Minnesota statutes governing receiverships and assignments for the benefit of creditors. Group attorneys are very active as members of and leaders in a number of professional insolvency organizations. For example, our attorneys are active in and in some cases held leadership positions in, including the Business Bankruptcy Committee of the American Bar Association Section of Business Law, the American Bankruptcy Institute, the Turnaround Management Association (Upper Midwest Chapter), the Hennepin County Bar Association Debtor/Creditor Section, and the Minnesota State Bar Association, Bankruptcy Section. In addition to holding leadership positions in these organizations, two of our attorney group members are also co-instructors of the Bankruptcy Clinic at the University of Minnesota Law School; one is a nationally Certified Business Bankruptcy Specialist and two are Fellows in the American College of Bankruptcy. Group members are routinely recognized by their peers as “Super Lawyers” and “Best Lawyers in America”.
