I-9 Employment Eligibility Verification Compliance: USCIS Issues Revised M-274 Handbook for Employers

On January 5, 2011, USCIS issued a revised Handbook for Employers to assist employers with the I-9 Employment Eligibility Verification form. This handbook is an essential guide for employers in completing the Form I-9, Employment Eligibility Verification Form. The handbook has been revised with new information, such as:

  • New visual aids for completing Form I- 9

  • Examples of new relevant USCIS documents

  • Expanded guidance on the completion of Form I-9 for:

    • Lawful permanent residents
    • Refugees and asylees
    • Individuals in Temporary Protected Status (TPS)
    • Exchange visitors and foreign students
    • Employees under H-1B or H-2 portability including required supporting documentation
    • Extensions of stay for employees with temporary employment authorization

  • Guidance regarding electronic storage and retention of I-9 forms

The Handbook for Employers now also includes information for employers in the Commonwealth of the Northern Mariana Islands (CNMI) who must verify their employees’ employment authorization on Form I-9 CNMI and highlights information about documents CNMI employers may accept from their employees.
