Tax Credit and Incentive Financing

representative transactional work

As a one-stop law firm for renewable energy and clean technology developers, manufacturers, and financers, Fredrikson’s attorneys understand that incentive financing can make the difference between a profitable project and an unprofitable one. We take a proactive approach to bolstering our clients’ bottom line, often suggesting tax credit or government financing opportunities that our clients may have otherwise missed.

Tax credits and government incentive programs are complicated. We keep track of them so you don’t have to.”

Our attorneys have served as counsel to project developers, community development entities, borrowers, tax credit investors, governmental agencies, and applicants for various types of government incentive programs. Our attorneys have structured and closed numerous renewable energy transactions involving the production tax credit and investment tax credit, the 1603 grant in lieu of the investment tax credit, grant and guaranteed loan projects from various federal agencies including the USDA, and state incentives for renewable energy and clean technology.

In addition, we have experience pairing renewable energy projects with general economic development government incentives. Our attorneys have closed more than a dozen New Markets tax credit transactions, including transactions coupled with 1603 grants, state New Markets credits for several states, FEMA grants, Community Development Block Grants, and bond financing.

Policy Experience and Government Connections

Our attorneys assisted in drafting the Minnesota Angel Tax Credit, one of the most popular tax incentives in Minnesota. We frequently interact with government agencies and lawmakers at both the federal and state levels to ensure that we understand how to make these programs work for our clients.

In addition to understanding the technical requirements of tax credit and incentive financing, our firm understands that a business lies at the heart of every incentive financing project. We strive to provide practical, bottom-line oriented legal advice to protect and further your business goals.
