NLRB Extends Deadline for Notice Requirements

We recently reported on the National Labor Relations Board’s (NLRB) final rule, requiring most private sector employers to notify employees of their rights under the National Labor Relations Act by posting a notice. 29 C.F.R. §104.201. The NLRB has postponed the effective date from November 14, 2011 to January 31, 2012.
Court challenges to the notice requirements were filed in September 2011 but unless and until those challenges are successful or the Board acts further to withdraw or amend the requirements, employers will need to comply with the new notice requirements.
