Selected Insurance Coverage Cases:

  • Lakehead Pipeline Co. v. American Home Assurance Company, 981 F. Supp. 1205 (D. Minn. 1997), 177 F.R.D. 454 (D. Minn. 1997): Coverage claim against property insurers for $25 million in property and business interruption losses resulting from rupture of a major crude oil pipeline.  Obtained pretrial order requiring insurers to post security bonds for their potential liability.  Reached confidential settlement with insurers for client’s losses.
  • Bright Wood Corp. v. Bankers Standard Ins. Co., 665 N.W.2d 544 (Minn. App. 2003): Prevailed in coverage action involving losses from multimillion-dollar recall of defective window units.
  • Domtar, Inc. v. Niagara Fire Ins. Co., 563 N.W.2d 724 (Minn. 1997): Represented amicus curiae insurance group on issues related to allocation of coverage between policy years in multimillion-dollar environmental liabilities.
  • Jenoff, Inc. v. New Hampshire Ins. Co., 558 N.W.2d 260 (Minn. 1997): Coverage action involving fire damages.
  • Redeemer Covenant Church of Brooklyn Park v. Church Mut. Ins. Co., 567 N.W.2d 71 (Minn. App. 1997): Prevailed on insurance claim for coverage of Church’s settlements of several molestation cases in which Church was vicariously liable.
  • Data Sales Co., Inc. v. Federal Insurance Company, U.S. District Court, District of Minnesota, Court File No. 01‑CV‑1801 PAM/FLN: Coverage and bad faith action against insurer under Inland Marine Policy for computer equipment lessor following disappearance of leased computers.  Insurer settled by paying claim.
  • Bruce E. Adams, M.D. v. The Penn Mutual Life Insurance Company, Hennepin County District Court File No.: DJ 98-3244: Prevailed in jury trial for disability insurance benefits for an emergency room physician.
  • Auto Owners Ins. Co. v. Autotraac, Inc., Not Reported in N.W.2d, 1997 WL 698482 (Minn. App. 1997): Auto liability insurance coverage action.
  • Chaffin v. Minnesota Life Ins. Co., Ramsey County District Court File No. 62-C6-03-013057: Action against insurer that refused to pay life insurance benefits to widow following death of her spouse because of alleged misrepresentation in policy application.  Insurer paid settlement on eve of trial.
  • Jasper State Bank v. Kansas Bankers Surety Co., Pipestone County District Court File No. C3-03-327: Action against insurer on fidelity bonds issued to a bank.  Insurer paid settlement on eve of trial.
  • World Satellite Network, Inc. v Hartford Fire Insurance Company, U.S. District Court for the District of Minnesota, Court File No. 98-CV-1184 DSD/JMM: Action against insurer for coverage of employer’s settlement of several sexual harassment cases.  Insurer paid settlement prior to trial.
  • AlumiPlate, Inc. v. Hartford Casualty Insurance Company, Hennepin County District Court File No. CT 01-011506: Action against property and business interruption insurer for losses caused by damage to insured’s operating equipment.  Insurer paid settlement prior to trial.
