Introduction - Antitrust Bio

Todd Wind is a shareholder and co-chair of Fredrikson & Byron’s Litigation Group. He has 21 years of experience in general commercial litigation with a particular focus on antitrust matters. Todd has represented companies in government investigations (Department of Justice and state Attorney General proceedings) and civil lawsuits in state and federal court involving claims of predatory pricing, price discrimination, monopoly leveraging, monopolization and attempted monopolization, exclusive dealing and price fixing. Todd also has significant experience in class action and multi-district litigation.

Representative Experience

Antitrust and Trade Regulation:

Todd has represented clients in a broad range of industries in virtually every aspect of antitrust and trade regulation. 

  • In re Milk Products Antitrust Litigation:  Todd served as lead counsel in a series of cases against dairy products manufacturers.  The cases began with grand jury proceedings initiated by the U.S. Department of Justice and included private class actions in state and federal court.  Our client was not charged with any wrongdoing and prevailed in all of the civil actions that were filed.  See 195 F.3d 430 (8th Cir. 1999).
  • In re Brand Name Prescription Drug Litigation:  Todd represented three pharmaceutical manufacturers in direct and indirect purchaser class actions brought by consumers and retail pharmacies in state and federal court.  As part of the joint defense group, Todd helped lead a coordinated defense that ultimately defeated class certification which lead to favorable settlements.   
  • In re Vitamins Antitrust Litigation:  From 1999 to 2006, Todd was involved in the Vitamins Antitrust Litigation, which was one of the largest antitrust proceedings in U.S. history. Todd was appointed by the Court as liaison counsel in the coordinated actions in Ramsey County, and was involved in the multi-district litigation in Washington D.C.
  • HDC Medical, Inc. v. Minntech Corp., 411 F.Supp.2d 1096, 2006 WL 212191 (D. Minn):  Todd represented Minntech Corporation, a medical device manufacturer, in an action brought by a competitor alleging monopoly leveraging, tying, attempted monopolization and various other claims relating to Minntech’s sales policies, including warranties, service, and the pricing of companion products.  Todd was successful in obtaining summary judgment in favor of Minntech.  HDC appealed the decision to the Eighth Circuit.  The Court of Appeals affirmed the decision in Minntech’s favor.  474 F.3d 543, 2007 WL 174398.
  • In re MSG Antitrust Litigation:  Todd represented Samsung Corporation in a class action alleging price fixing and market allocation relating to monosodium glutamate and other products.
  • Ace Pro Sound & Recording LLC v. Guitar Center et al:  Todd is currently involved in an antitrust action in the United States District Court for the Southern District of Florida, representing a manufacturer of sound and recording equipment against claims of price fixing, conspiracy and attempted monopolization.
