Premium Processing Resumed

USCIS resumed premium processing on Tuesday, March 12, for all H-1B petitions. If a petition previously received a request for evidence (RFE) and it is still pending, the applicant must include the RFE response with the premium processing request. A premium processing request to USCIS guarantees a 15-day turn-around, to include an approval or an RFE. If USCIS does not take adjudicative action within the 15‑calendar day period, USCIS will refund the petitioner’s premium processing fee and continue with expedited processing of the petition.
It is unclear at this time whether Premium Processing will be extended to cover FY 2020 H-1B cap cases.
