Sora 2 from OpenAI has launched and looks amazing! I can't wait to play, explore and create.

But for all my clients and colleagues, please remember:

  1. The output from generative AI tools, including OpenAI/Sora, is not copyrightable or patentable. You do not own it. No one owns it. And that means others can take, use and modify your creations.
  2. You must still do "clearance" on any media or content you put out into the world. A video like the linked example could, potentially, infringe on copyright, trademark, name-image-likeness, privacy, or other rights. For example, if you prompt, "Create a video showing someone who looks like Leonardo DiCaprio using my company's product while driving a Porsche," you may be violating Leo's name-image-likeness rights as well as violating trademark and other rights of Porsche.
  3. For work and business uses, strongly consider adopting a Generative AI Use Policy. And think about what it says. (Do not just cut and paste off the Internet.)
  4. For work and business uses, strongly consider having approved tools, and an Enterprise License, so that your employees are not using the "free" version on their smartphone or home computer. That is super risky.
