Tom Brett

Tom advises clients on matters related to environmental and energy regulation, compliance, permitting and litigation.

Tom has litigated environmental matters before federal district and circuit courts, as well as California state courts. He counsels clients on compliance with federal and state environmental laws and regulatory programs, including the Clean Air Act and the Clean Water Act. He advises clients on product regulatory and environmental compliance requirements, including Extended Producer Responsibility (EPR) laws, California's Proposition 65, and PFAS labeling, reporting, and disclosure obligations. Drawing on this combined litigation, regulatory, and compliance background, he helps clients navigate the often-complex environmental regulatory landscape.

• Litigated claims arising under cornerstone environmental and administrative laws, including the: Clean Water Act, Endangered Species Act, National Environmental Policy Act, Resources Conservation and Recovery Act, Administrative Procedure Act, California Environmental Quality Act and California’s Proposition 65 law.
• Counsels clients on compliance with federal and state environmental laws and regulatory programs, including permitting, reporting, enforcement, and compliance obligations under the Clean Air Act and Clean Water Act.
• Advises manufacturers, producers, and other businesses on product regulatory and environmental compliance requirements, including Extended Producer Responsibility (EPR) laws, California's Proposition 65, and PFAS-related labeling, reporting, notification, and disclosure requirements.
• Helps clients assess regulatory risk, develop compliance strategies, and respond to government investigations, enforcement actions, and citizen-suit claims.
