Overview

The Medicare Manuals provide thousands of pages of detailed program guidance beyond what the statutes and regulations say. Is this guidance binding? Can it serve as the basis for a recoupment action? Or a False Claims Act suit? Do you have to refund if you discover past practice didn’t conform to Manual guidance? Our August 2019 Health Law Webinar explored these questions and discussed trends and recent case law dealing with the use of Manuals, FAQs, memos and other program guidance.
