Luke de Leon is an intellectual property attorney specializing in strategically counseling clients on trademarks, copyrights, and patents.

His focus is on resolving disputes efficiently and strategically to provide comprehensive intellectual property and brand protection to his clients. He works closely with his clients to deliver custom-tailored, brand-aligned solutions to arising intellectual property issues, in court, before the U.S. Patent and Trademark Office (USPTO), and online.

Luke’s practice is centered on trademark-related disputes, both in federal court and before the Trademark Trial and Appeal Board (TTAB). He strategically advises clients on effective enforcement and brand protection solutions in the digital space, including unauthorized uses of trademarks and identities on social media, e-commerce platforms, and other online channels.

Clients value Luke’s ability to balance legal strategy with business priorities. He is known for identifying practical, cost-effective paths forward and for taking the time to understand how each client’s intellectual property positions it within their relevant market segment.

Prior to joining Fredrikson, Luke served as a law clerk for Justice Natalie E. Hudson of the Minnesota Supreme Court and as a judicial intern for the Honorable Stephani Humrickhouse of the U.S. Bankruptcy Court in the Eastern District of North Carolina.

Luke sits on the firm’s Recruitment and Hiring Committee, he enjoys the opportunity to connect with law students and new attorneys.

In his free time, Luke enjoys running/cross-country skiing through a park, looking at birds, or experimenting with new recipes in the kitchen.

  • Lead attorney on over 12 trademark opposition and cancellation proceedings before Trademark Trial and Appeal Board (TTAB) involving a wide range of domestic and international companies.
  • Represented a well-known nonprofit addiction-treatment center in a federal trademark infringement lawsuit involving complex cross-border jurisdiction and discovery issues, resulting in favorable settlement for the client.
  • Member of a team that represented the Prince Estate of Prince Rogers Nelson in litigation protecting the late star’s intellectual property assets.

Advertising and Marketing Experience

  • Counsels a best-selling author and thought leader in the health and wellness space on full online brand protection including monitoring and strategic enforcement of trademark and publicity rights in connection with online advertising and social media marketing.
  • Advises clients on enforcement and defense of trademarks, copyrights, and domain names through cease-and-desist letters, Digital Millennium Copyright Act (DMCA) notices, and proceedings before the TTAB.

Patent, Copyright, and Other IP Litigation

  • Trial team member defending against correction of patent inventorship claims in the District of Delaware involving patented technology and methods in the food processing industry.
  • Represented a start-up search technology company in trade secret misappropriation case in California involving state and federal claims resulting in a favorable outcome.

Pro Bono

  • Representing a local non-profit arts organization in defense of claims brought under the Copyright Act.
  • Advises a minority-owned, small business on trademark matters, including acquisition, defense, and strategic enforcement of rights.
  • Briefed and argued an appeal to the Minnesota Court of Appeals as a special public defender on behalf of a client asserting violations of his constitutional rights.
